Patient safety is caught between the tension of as innovative and promising treatments as possible and the associated only partially controllable risks. The legal framework is shaped by a variety of professional and organizational legal requirements from individual clarification to international hygiene standards – as well as the largely autonomous patients, but also possible cooperation obligations. Medical action often takes place here in the "shadow of the Leviathan" with regard to possible civil and criminal liability. Michael Ganner is a university professor of civil law and fundamentals of legal science at the University of Innsbruck and head of the Institute for Civil Law. Ensuring patient safety is one of the central leadership tasks of a chief physician. Medical progress, increasing specialization, economic conditions and growing regulatory requirements make patient care more complex today than ever. Safety is created not only through professional excellence, but above all through reliable structures, clear processes and a lived safety culture. The lecture sheds light on patient safety from the perspective of a chief surgeon and shows, using practical examples, the contribution that leadership, organizational culture, standardization, interprofessional cooperation and a learning error culture make to safe, high-quality and future-oriented patient care. The focus is on the question of what really matters in clinical practice to build trust, control risks and promote a culture of continuous improvement. Walther Tabarelli, born 1971; studied medicine at the Leopold-Franzens-University Innsbruck; doctorate in medicine (2004); doctoral studies in medical sciences at the Private University in the Principality of Liechtenstein (UFL), doctorate in medical science (2010); specialist in general surgery (2010), emergency physician (2010); additional specialist in vascular surgery (2012); FMH training authorization for surgery (2019); senior physician at the Bludenz Regional Hospital (2013); member of the hospital management of the Liechtenstein National Hospital (until February 2020); chief surgeon at the Liechtenstein National Hospital.
